These Terms of Service ("Terms") govern your use of Maxwill Hosting services ("Services"). By using our Services, you agree to these Terms.
Services Provided
Maxwill Hosting provides:
- VPS Hosting: Virtual private servers with full root access
- Web Hosting: Managed hosting for websites and web applications
- Email Hosting: Private email servers with your domain
- Messenger Hosting: Matrix, XMPP, SimpleX server hosting
Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Keeping your contact information up to date
- Backing up your data (we provide tools, but you are responsible)
- Complying with applicable laws in your jurisdiction
Acceptable Use Policy
You may use our Services for any lawful purpose. However, the following are prohibited:
Prohibited Content
Zero tolerance. Immediate termination without refund:
- Child sexual abuse material (CSAM)
- Content promoting terrorism or violence
- Doxing or coordinated harassment
Prohibited Activities
Will result in suspension or termination:
- Network attacks (DDoS, port scanning, intrusion attempts)
- Sending spam or unsolicited bulk email
- Phishing or fraud schemes
- Cryptocurrency mining without prior approval
- Running Tor exit nodes without prior approval
- Excessive resource usage affecting other customers
- Reselling services without authorization
Service Level Agreement (SLA)
We commit to the following uptime guarantees:

| 99.0% - 99.9% | 25% credit |
| 95.0% - 99.0% | 50% credit |
| Below 95.0% | 100% credit |
SLA exclusions:
- Scheduled maintenance (announced 24 hours in advance)
- Downtime caused by customer actions
- DDoS attacks targeting your services specifically
- Force majeure events
Payment Terms
- Billing: Services are billed monthly in advance
- Payment Methods: Credit card, cryptocurrency, bank transfer
- Late Payment: 7-day grace period, then service suspension
- Refunds: Pro-rated refunds for annual plans within 30 days
- Taxes: Prices exclude applicable taxes
Data and Backups
- You retain full ownership of your data
- We provide backup tools, but backup responsibility is yours
- Data is deleted within 7 days of service termination
- You can request data export at any time
DDoS Protection
- Basic DDoS protection is included with all services
- We reserve the right to null-route IPs under extreme attack
- Persistent attack targets may require additional mitigation
- You will be notified of any protective actions taken
Suspension and Termination
By You
- Cancel anytime through your control panel
- Data preserved for 7 days after cancellation
- Pro-rated refund for unused annual prepayment
By Us
- Immediate termination for AUP violations
- Suspension for non-payment after grace period
- 30-day notice for service discontinuation
Limitation of Liability
- Maximum liability is limited to fees paid in the last 12 months
- We are not liable for data loss, business interruption, or indirect damages
- Services are provided "as is" without warranty beyond SLA
Privacy
Our Privacy Policy is incorporated into these Terms. Key points:
- We operate under a strict no-logging policy
- We don't monitor your traffic or server content
- We require valid legal process for any data disclosure
Changes to Terms
- We may update these Terms periodically
- Material changes notified 30 days in advance via email
- Continued use after changes constitutes acceptance
